Insurance Bad Faith Claims

Insurance bad faith occurs when an insurance company fails to handle an insured person or business' claim appropriately. For example, if you are in a car accident and your insurance fails to settle the case against you - despite knowing that the probable verdict against you will be far larger than your insurance policy limits - that is bad faith. Bad faith can occur in many other ways, including failing to pay, underpaying or denying a valid claim; representing information about an insurance policy that is not true; and, placing the insurance company's interests above the insured's. In addition, insurance agents may be acting in bad faith if they fail to obtain the insurance requested, delay in placing insurance, or place the wrong coverage.

Insurance bad faith cases are complex, and require thorough investigation. Often these cases involve many witnesses, including insurance agents and adjusters, as well as lawyers who have been involved in the case. In addition, it is highly important to review and analyze all of the insurance company's documents, letters and other records, so that it can be determined what the insurance company knew, when it knew it, and when it made decisions in bad faith.

Winning these cases is not easy. The insurance companies will almost always deny any fault, and they will often try to blame the insured for their own misconduct. Plus, insurance companies have lots and lots of lawyers to defend them in bad faith cases, and they generally fight harder to defend themselves than they do to defend their insureds.

At Pogust Braslow & Millrood, we fight insurance companies every day, and accept cases from individuals and businesses who have been victims of bad faith conduct by insurance companies. These claims often require special skill and expertise in order to obtain the best results possible, and we fight harder than the insurance companies to assure that our clients are treated fairly and are compensated for whatever damages they are entitled to.

We investigate every case thoroughly so our clients are assured that we will not back down and that we will make the insurance company pay for its actions.
